Travelocity advertising “borrowing” heavily on fine-art?

Advertising that looks just like someone’ s fine-art? An artist I know, painter/photographer Gregory Scott has been creating these unique works that combine his paintings with photography and showing them for many years (Catherine Edelman Gallery, photograhers:network 2007, Museum of Contemporary Photography, ArtWorldChicago.com Feb 2006, etc.).
Now I see this from a Travelocity ad that seems to be a straight steal from his visual vocabulary (and an attempt at his humor). This is in Nov/Dec 2007 Good magazine (Issue007).

Gregory I hope you are getting paid by them because if you’re not, I’m pissed. I don’t really understand the legality behind this sort of thing, so maybe I’m just confused.
Funny thing is this ad is for Travelocity’s “Travel for Good” campaign. Funny they want to help others and take from an artist?
